Short-Term Rental Regulations in Watauga County: What Investors Need to Know

The NC High Country is one of the Southeast's strongest short-term rental markets — but that doesn't mean every property in every location pencils out as an Airbnb investment. Before you buy, you need to understand the regulatory landscape. It varies significantly depending on whether you're buying inside town limits, in an HOA community, or on unincorporated county land.

Here's what I tell every investor client before we start looking at properties.

Watauga County STR Regulations (Unincorporated Areas)

Watauga County adopted a Short-Term Rental Ordinance that applies to properties outside any incorporated town limits. Key points:

  • Registration Required. All STR operators in unincorporated Watauga County must register their property with the county. Operating without registration can result in fines and forced closure.
  • Occupancy Limits. The ordinance sets limits tied to the number of bedrooms. You can't advertise for 20 guests in a 3-bedroom cabin.
  • Life Safety Requirements. Smoke detectors, CO detectors, fire extinguishers, and posted emergency information are required. Properties are subject to inspection.
  • Local Contact Requirement. You must designate a local contact person who can respond to complaints within a reasonable timeframe — critical if you're managing remotely from Atlanta or Charlotte.
  • Advertising Compliance. Your registration number must appear in all advertising, including Airbnb and VRBO listings.

Town of Boone STR Rules

The Town of Boone has its own STR overlay and has been tightening regulations as the housing market has tightened. Within Boone town limits, STRs are only permitted in certain zoning districts — you cannot assume that because a property is in Boone, it qualifies for STR operation.

This is one of the most important due diligence steps I walk clients through: pulling the Town of Boone Zoning Map (last amended December 4, 2023, with 21 distinct district codes) and confirming the target property's zoning before making an offer. If you're buying specifically for STR income inside Boone city limits, this step is non-negotiable.

Blowing Rock and Banner Elk

Both towns have their own permitting requirements. Blowing Rock has historically been more permissive of vacation rentals given its long history of seasonal tourism. Banner Elk has strong vacation rental tradition around the ski resorts. Even so, HOA rules often matter more than town rules. Many mountain communities have deed restrictions that prohibit or limit short-term rentals regardless of what the municipality allows. Always pull HOA documents and CC&Rs before making an offer.

Tax Obligations

North Carolina requires STR operators to collect and remit:

  • State Sales Tax (4.75%)
  • County Occupancy Tax — Watauga County levies 6% on STR revenue
  • Town/Municipality Taxes where applicable

Platforms like Airbnb and VRBO collect and remit some of these automatically, but not all. Work with a CPA who has experience with STR taxation — I can refer you to local accountants who know this cold.

What Actually Cash-Flows in This Market?

The factors that most drive STR performance in the High Country:

  • Views. Long-range mountain views command a significant premium on nightly rates and occupancy.
  • Hot tub. At this elevation and in this market, a hot tub is nearly mandatory for competitive STR performance.
  • Proximity to ski slopes. Banner Elk and Beech Mountain properties near Sugar Mountain and Beech Mountain Resort drive high winter occupancy — the season where the real money is made.
  • Sleeping capacity relative to purchase price. A 5-bedroom at $600K may outperform a 3-bedroom at $450K on net ROI.
  • Pet-friendly policy. Allowing dogs significantly expands your potential guest pool.
